By using our website, submitting an enquiry, or engaging Bold Habitat for design services, you agree to the following Terms & Conditions.

These terms are intended to keep projects clear, fair, and straightforward for both sides.

01 — OUR SERVICES

Bold Habitat provides creative and design services including, but not limited to:

Logo Design
Brand Identity Development
Print & Advertising
Packaging Design
Graphic Design
Creative Direction
Other design services agreed upon with the client

The exact scope, deliverables, timeline, pricing, and number of revisions will depend on the package or individual project agreed upon.

02 — PROJECT START

A project is considered confirmed only after the required advance payment has been received and the project scope has been mutually agreed upon.

Work will generally begin after we receive the required information, content, references, assets, and approvals from the client.

03 — PAYMENTS

All prices displayed on our website are starting prices unless specifically stated otherwise.

The final project fee may vary depending on the scope, complexity, number of deliverables, additional requirements, and revisions.

Any additional work outside the agreed scope may be charged separately.

Unless otherwise agreed in writing, project payments must be made according to the payment schedule provided in the quotation or invoice.

04 — REVISIONS

The number of revisions included in a project depends on the service/package selected.

A revision means a reasonable modification to an existing design direction. It does not mean starting the entire project again with a completely different concept.

Requests that substantially change the approved direction, scope, or deliverables may be treated as additional work and charged accordingly.

05 — CLIENT RESPONSIBILITIES

The client is responsible for providing accurate and timely:

Brand information
Text and copy
Images and photographs
Logos and existing brand assets
Product information
Legal or regulatory information
Feedback and approvals

Delays in providing required information or feedback may affect the agreed project timeline.

06 — PROJECT TIMELINES

Any timeline shown on our website is an estimated working timeline and may vary depending on project requirements.

The timeline begins once the project is confirmed and all required materials and initial information have been received.

Client delays, additional revisions, changes in scope, or delayed approvals may extend the project timeline.

07 — APPROVALS

Once a design or project stage has been approved by the client, Bold Habitat may proceed to the next stage.

Changes requested after approval may be considered additional revisions and may incur additional charges.

The client is responsible for checking spelling, names, numbers, measurements, product information, legal statements, and other factual details before final approval.

08 — INTELLECTUAL PROPERTY

Unless otherwise agreed, all original final design work created specifically for the client and fully paid for will be transferred to the client upon completion/payment of the project.

Bold Habitat retains ownership of unused concepts, rejected designs, sketches, drafts, explorations, working files, and internal creative development unless specifically agreed otherwise.

Third-party fonts, stock images, illustrations, software, templates, or other licensed assets remain subject to their respective licensing terms.

09 — SOURCE / WORKING FILES

Editable source files or working files are provided only when specifically included in the agreed scope.

If source files are not included in the selected package, they may be made available separately at an additional fee where applicable.

10 — CLIENT-SUPPLIED MATERIALS

The client confirms that they have the necessary rights and permissions to use any images, text, logos, fonts, photographs, trademarks, or other materials supplied to Bold Habitat.

Bold Habitat is not responsible for copyright, trademark, licensing, or other legal claims arising from materials supplied by the client.

11 — CANCELLATION & REFUNDS

If a project is cancelled after work has begun, payments for work already completed, time invested, or services already provided may not be refundable.

If a project remains inactive for an extended period due to client-side delays, Bold Habitat may consider the project closed or paused. Restarting the project may require a revised timeline and/or additional charges.

Any refund, where applicable, will be determined based on the work completed and the terms agreed in the project quotation.

12 — PORTFOLIO & SELF-PROMOTION

Bold Habitat may display completed work in its portfolio, website, social media, presentations, awards, and other promotional material to demonstrate its work.

If a project contains confidential information or has specific confidentiality requirements, the client may request that the work not be publicly displayed. Such arrangements should be agreed upon before or during the project.

13 — THIRD-PARTY SERVICES

Certain projects may require third-party services, production partners, printers, manufacturers, stock libraries, fonts, hosting providers, or other external vendors.

Unless specifically agreed otherwise, Bold Habitat is not responsible for delays, errors, pricing changes, technical issues, or service failures caused by third-party providers.

14 — PRINTING & PRODUCTION

For print and packaging projects, colour, material, texture, dimensions, finishing, and final output may vary slightly between digital previews and physical production.

The client is responsible for approving final artwork before production.

Once final artwork has been approved, Bold Habitat is not responsible for errors introduced by the client or production vendor after approval.

15 — WEBSITE CONTENT

The content, graphics, text, and visual materials displayed on the Bold Habitat website are provided for general information and may change without prior notice.

We make reasonable efforts to keep information accurate but do not guarantee that every piece of website content will always be complete, current, or error-free.

16 — LIMITATION OF LIABILITY

Bold Habitat will make reasonable efforts to deliver work according to the agreed scope and professional standards.

However, Bold Habitat will not be liable for indirect, incidental, consequential, or business losses resulting from the use of our services, designs, website, or third-party services.

Our liability, where legally applicable, will be limited to the amount paid by the client for the specific service giving rise to the claim.

17 — CHANGES TO TERMS

We may update these Terms & Conditions when necessary.

The latest version published on this website will apply to future enquiries and projects unless a separate written agreement has been made with the client.

18 — GOVERNING LAW

These Terms & Conditions shall be governed by the laws applicable in India.

Any disputes relating to our services or these terms will be subject to the applicable jurisdiction of West Bengal, India.
